1. Who we are
Respaldo RD ([RAZÓN SOCIAL PENDIENTE], RNC [RNC PENDIENTE]) is a private lender that makes loans secured by vehicles or real estate with its own capital, and operates the website respaldord.com. Respaldo RD is not a bank. We are the controller of the data you send us in your loan application.
This policy explains how we handle your personal data under Ley núm. 172-13 on the Comprehensive Protection of Personal Data and other applicable laws of the Dominican Republic.
2. Data we collect
- Identification and contact: name, last 4 digits of your cédula, WhatsApp number and city.
- Application data: loan type, amount and currency requested (US$ or RD$), residence in the DR, and collateral details (vehicle year, make and model; or property type, location, estimated value and title status).
- Financial data: how you earn your income and whether the collateral earns income, with an estimate if you provide one.
- Minimal technical data: approximate country of connection (derived from your IP) and the date and time of submission, to prevent fraud.
- Anonymous usage statistics: we use Cloudflare Web Analytics to count visits and measure site speed (pages viewed, country, device and browser type, referring site). It uses no cookies, doesn’t store your IP or build a profile of you, and isn’t combined with form data.
We don’t ask for your full cédula number, passwords, card details or banking information through the site.
3. How we use your data
- To assess your loan application with Respaldo RD, including inspection or appraisal of the collateral.
- To contact you by WhatsApp, phone or email about your application.
- To prepare, formalize and manage your loan, if approved.
- Only if you separately authorize it: to present your application to partner lenders when we can’t finance it ourselves.
- To prevent fraud and meet legal obligations.
We don’t sell your data or use it for purposes other than those listed without your consent.
4. Legal basis: your consent
We process your data based on the free, express and informed consent you give in the loan application. There are two separate authorizations:
- Required: for Respaldo RD to process your data and assess your application. Without it we can’t process the application.
- Optional: for us to present your application to partner lenders if we can’t finance it. If you don’t tick it, your data is not shared with any partner.
We record which of the two you gave, with the version of the text, the language and the date. You can withdraw either one at any time (see section 8), without retroactive effect.
5. Who we share your data with
- Partner lenders: only if you ticked the optional authorization and we can’t finance your application. Each lender is responsible for its own processing from that point on, under its own privacy policy. You can ask us for the list of lenders your information was sent to.
- Technology providers: web hosting, the form and anonymous statistics (Cloudflare, Inc.) and storage of applications and email (Google LLC), acting as data processors. We don’t use Google Analytics or advertising tools.
- Authorities: when a law or court order requires it.
6. International transfers
Our technology providers may store or process data on servers outside the Dominican Republic. By accepting this policy you consent to that transfer, which is made to providers that apply internationally recognized security measures. [Lawyer to review: Ley 172-13 requirements for international transfers.]
7. Retention
We keep your data for [24 months] from your last interaction or until you request deletion, unless a legal obligation requires us to keep it longer.
8. Your rights
As the data subject you may at any time exercise your rights of access, rectification, cancellation (deletion) and objection, and withdraw your consent. Write to privacidad@respaldord.com or message us on WhatsApp at +1 (809) 000-0000, stating your name and the right you wish to exercise. We will respond within the time limits set by Ley 172-13. If you are not satisfied with the response, you may contact the competent authorities.
9. Cookies
This site doesn’t set advertising, tracking or analytics cookies, which is why we don’t show a cookie banner. If we ever use tools that require them, we will update this policy and ask for your consent before turning them on.
10. Security
We apply reasonable technical and organizational measures: encrypted connections (HTTPS), restricted access to data and minimal collection (for example, only the last 4 digits of the cédula).
11. Minors
Our service is for people aged 18 and over. We don’t knowingly collect data from minors.
12. Changes to this policy
We may update this policy. We will publish the new version on this page with its update date.
